BMW System Case Latches Covered Under the Factory Warranty?

I suspect my chances are slim here, but I have a whopping 80 miles left on my factory warranty, and before I call to see if this is covered, I thought I would solicit the board's wisdom.

 

One of the latches on my side case failed to release. It's busted, not through abuse or misuse.

 

The cases were a part of the bike's purchase. Are the cases considered a part of the bike and therefore covered under the manufacturer’s warranty? I plan to call the dealer tomorrow, but would welcome advice before I do that.

Yes, the bags are covered in the 3 year/36,000 warranty. They would be even if purchased as a accessory, if purchased together with a new bike.
