Not that I would ever do such a thing (wink, wink, nudge, nudge) but, is it fleeing if he can truthfully state he never saw them coming? Is it evading for the same reason? I have no doubt that a judge would laugh in his face just before bringing down the gavel and pronouncing him guilty on all charges but, he might never have known they were chasing him. I'm pretty sure an RTP can't hit those speeds and I know the city police cars, at least in my neck of the woods, won't make that. If then, he had to slow down before they could catch him, how could that be classified as fleeing? All of the above with tongue firmly in cheek. Link to comment

If it's the section of road I think it might be (M81 that runs from Saginaw into the thumb of MI) I commuted that road for 1.5 years in the mid 90's. 137 MPH just might make that road interesting. John, I’m sure the lights & siren were not going behind the defendant if he was doing 137mph.. Those Crown Vics aren’t up to that task.. If you didn't know you were being pursued it doesn't matter. The police knew they were pursuing and they make the charges. Must love his job. Link to comment
