cpayne Posted July 28, 2012 Posted July 28, 2012 My Brother got hit in the rear end on June 07. Legal advice recommend he by the bike from the insurance company until all legal matters are resolved. Is the bike repairable . https://plus.google.com/photos/100623621497716153476/albums/5770340570912024289?authkey=CNn7zpu0uqyRkwE Zooming in on the pics shows most damage. I can try to post better shots later if needed. There were no fluids leaking other than fuel. I think the disconnects came loose and cause the fuel leak. According to witnesses the bike shot in the air about 8 feet and spun around and landed on the mailbox pointing the opposite direction. My brother high sided about 217 feet forward in the original direction of travel. Thanks
bmw_rider Posted July 28, 2012 Posted July 28, 2012 GIven what I have been seeing for prices for used bikes and the extensive damage on this one-- pretty clear in my mind -- part it out.
tallman Posted July 28, 2012 Posted July 28, 2012 Most likely a total loss if you're goal is to put it back the way it was. Could be a frankenbike if all mechanical ok and you go cheap but too many parts/sub frames/ body pieces needed. Prolly worth determing engine condition though. Good luck and hope he is ok. BTDT w/the hit from rear...
4wheeldog Posted July 28, 2012 Posted July 28, 2012 I can see at least $8k in parts, not to mention labor, to fix. And the engine might be junk, if it was running when it wound up in that position. So, totaled. There might not be all that much to part out. The transmission and final drive, but nothing else jumps out as being undamaged.
mneblett Posted July 29, 2012 Posted July 29, 2012 If your brother does part it out, let me know -- I'm in Northern VA, and about to start a rebuild on my '04 RT-P. Would your brother be interested in selling the remnents as is?
azccj Posted July 29, 2012 Posted July 29, 2012 If it were mine I wouldn't want anything to do with it anymore. It looks totaled to me and not worth investing any more money into it. I'm guessing that there is some type of dispute of who is at fault or how much at fault, concerning the accident. Having gone through a few of these legal battles I can tell you that these insurance companies really like to hang onto their money as long as possible even when they concede that their driver is 100 percent at fault. In my last battle where a nice elderly gentleman decided to turn left in front of me, his insurance company accepted full responsibility within 2 days. Paid me a fair settlement within a week for my totaled 10 month new bike, clothing and helmet, $17,000+. Then wanted to pay me next to nothing for my injuries and missed work, like $1800. It took over two years before the case finally settled and I got maybe $3500.00 which I had to share with my lawyer and pay a medical bill. If your brother was seriously injured and the other driver had good insurance, meaning high liability coverage, 100K+, he is most likely going to have a long drawn out battle involving lawyers who are going to take a big bite out of anything they get out of the insurance company, usually 1/3 plus any expenses and that assumes the case doesn't go to trial. If they go to trial the lawyer usually wants more of a percentage, like 40% plus expenses for court costs, medical experts and so on. So you can see, even if the other drive is found 100 percent at fault it is very likely that your brother may get less than half of anything the insurance company eventually pays. Now if the other driver has crappy insurance or no insurance then your bro is screwed. Sorry I got a little off topic. And I hope your brother is doing alright.
cpayne Posted July 29, 2012 Author Posted July 29, 2012 There is legal action pending. He spent almost a month in the hospital. 11 days in a coma, but has done really well considering. Currently it looks to be a million for the bills. If it were mine I wouldn't want anything to do with it anymore. It looks totaled to me and not worth investing any more money into it. With a million dollar hospital bill and if the other driver had insurance or it was a commercial vehicle that hit him, the lawyers will be lining up to represent him. There was three questions every lawyer I called asked when deciding if they would take the case. 1. Did the other guy have insurance or did I have under/uninsured insurance? This was always the first question. 2. How bad was I hurt? 3. Who was cited for the accident?
RTCHIEF Posted July 29, 2012 Posted July 29, 2012 I bought an 04RTP that had been partly civilianized. Then I started collecting parts to finish it out. Some of the parts deals had extra pieces, now I have tons of pieces to sell. Some of the larger parts. Front frames, rear frame, bran new side panels, tac and speedometer, front headlight fairing and new mounts, windscreen, chin fairing, kick stands, and a lot more. Really like to sell the lot. Yeah, got two 1150 RT if anybody would like to adopt. Small rehoming fee like craigslist. Jon
